New Bill Would Codify Trump’s Birthright Citizenship Executive Order Into Law

Rep. Brian Babin has introduced a bill that would end automatic birthright citizenship for children born in the U.S. to parents of illegal aliens.  

Automatic birthright citizenship, regardless of parent’s legal status, is “one of the abused aspects of our immigration system,” Babin, R-Texas, told The Daily Signal.  

Babin introduced the bill Tuesday, just one day after President Donald Trump signed an executive order ending automatic citizenship for children born to parents who are in the country illegally.  

Trump’s “executive order to end birthright citizenship marks a critical step forward, and now with the Birthright Citizenship Act of 2025, we can solidify these reforms into lasting law and codify them,” Babin said Thursday at a press conference with a group of GOP lawmakers who are backing the bill.  

The legality of Trump’s executive order and the Birthright Citizenship Act hinge on the interpretation of the 14th Amendment, which reads: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” 

Trump’s executive order contends that the 14th Amendment excludes from birthright citizenship those who are born in the U.S. but not “subject to the jurisdiction thereof.” Those who have entered the country illegally are not subject to the same “jurisdiction” as those who have entered the country legally, according to the Trump administration and the GOP lawmakers supporting the Birthright Citizenship Act.  

Rep. Mike Collins, R-Ga., said at Thursday’s press conference that many of the illegal aliens having babies in America are “not over here on vacation and just happen to go into labor. They’re coming across that border down there illegally, and there using us an international piggy bank.”  

Texas GOP Congressman Randy Weber predicted Thursday that “the radical left is going to lose their freaking minds over this.” 

The ink on Trump’s executive order was barely dry before the American Civil Liberties Union, along with several other left-leaning immigration groups, filed lawsuits to stop Trump’s executive action on Monday. In total, 22 states are suing to the Trump administration over the order to end automatic birthright citizenship. 

A federal judge Thursday temporarily blocked Trump’s executive order to end automatic birthright citizenship for children born to illegal aliens. 

U.S. District Judge John Coughenour called Trump’s order “blatantly unconstitutional,” granting the request made by Washington, Arizona, Illinois, and Oregon to place a temporary restraining order on Trump’s order until the courts can determine the constitutionality of the action. 

“I welcome” the lawsuits, Babin told The Daily Signal, adding, “We want the Supreme Court to hear this case and give us a final interpretation of the 14th Amendment.” 

Babin said he is convinced that the 14th Amendment has been wrongfully interpreted to automatically grant citizenship to anyone who is born in America. The 14th Amendment has become a “green light and an open invitation for people from all over the world to flood our system and to be able to gain and exploit this loophole,” he said.
