Education Department Finds California in Violation of Law for Allowing Boys in Girls Sports

The Department of Education has found California in violation of Title IX for allowing males in female sports and spaces.

The department’s Office for Civil Rights concluded its Title IX investigations into the California Department of Education and the California Interscholastic Federation for allegedly discriminating against women and girls on the basis of sex.

President Donald Trump signed an executive order Feb. 5 protecting women’s sports from biological male intrusion. Some states like Maine and California refused to comply, causing Education Secretary Linda McMahon to launch investigations into the apparent violation of Title IX, the 1972 law prohibiting sex-based discrimination in education programs and activities.

“The Trump administration will relentlessly enforce Title IX protections for women and girls, and our findings today make clear that California has failed to adhere to its obligations under federal law,” McMahon said. “The state must swiftly come into compliance with Title IX or face the consequences that follow.” 

California Gov. Gavin Newsom said on a podcast months ago that it’s “deeply unfair” for women to play against males in sports, yet the California Department of Education and the California Interscholastic Federation continued to allow transgender identifying males to play girls.

Due to the noncompliance finding, the Office for Civil Rights issued a proposed Resolution Agreement to both entities to resolve their Title IX violations.

The California Department of Education and the California Interscholastic Federation have 10 days to change their practices or face imminent enforcement action, including referral to the Department of Justice for proceedings.

Nicole Neily, president of parental rights group Defending Education, commended the department for its leadership.

“Female athletes in California, like all women and girls nationwide, should be protected from unfair and dangerous competition against male athletes,” Neily said. “California is violating the letter and spirit of Title IX and parents around the country—not just in California—are grateful for the bold action of the administration to ensure compliance.”
