House Oversight Panel Subpoenas Jill Biden’s ‘Work Husband’ Over Coverup

A House panel subpoenaed a top aide for former first lady Jill Biden on Thursday as part of the investigation into the cognitive decline of the 46th president and its suspected coverup. 

House Oversight and Government Reform Chairman James Comer, R-Ky., issued the subpoena to Anthony Bernal, former assistant to President Joe Biden and senior advisor to the first lady, to answer questions in a deposition on July 16. 

Bernal had previously confirmed his appearance for a voluntary transcribed interview on June 26. The White House counsel’s office informed him it was waiving executive privilege for the Oversight Committee’s investigation. He declined to show up for the interview, according to the committee.

The committee is also investigating the potential that unauthorized executive actions were taken using autopen signatures, including presidential pardons, on Biden’s final day in office in January. 

“Given your close connection with both former President Biden and former first lady Jill Biden, the committee sought to understand if you contributed to an effort to hide former President Biden’s fitness to serve from the American people,” says the letter signed by Comer to Bernal. “You have refused the committee’s request. However, to advance the committee’s oversight and legislative responsibilities and interests, your testimony is critical. Accordingly, please see the attached subpoena for testimony at a deposition on July 16, 2025.” 

Comer later posted on X: “Signed, sealed, delivered. Jill Biden’s work husband, Anthony Bernal, must appear before @GOPoversight. Let this subpoena send a clear message to Biden’s inner circle: We will stop at nothing to expose the truth about Joe Biden’s decline and unauthorized use of the autopen.”

The Comer letter notes Bernal’s lawyer “raised concern with the committee’s practice of providing interview topics only one week in advance” as insufficient time to prepare.

“While the committee disagrees and believes one week is more than sufficient, to demonstrate good faith, it transmitted interview topics to your counsel on June 13—nearly two weeks prior to the agreed upon interview date,” Comer wrote. 

Comer continued: “The committee seeks information about your assessment of and relationship with former President Biden to explore whether the time has come for Congress to revisit potential legislation to address the oversight of presidents’ fitness to serve, pursuant to its authority under Section 4 of the Twenty-Fifth Amendment or to propose changes to the Twenty-Fifth Amendment itself.” 

The 25th Amendment to the U.S. Constitution establishes procedures for removing a president who is unable to discharge the duties of the office because of incapacity.
