Trump Reacts to Supreme Court Ruling Allowing Use of Alien Enemies Act to Deport Venezuelan Illegal Aliens

The Supreme Court has ruled that the Trump administration can, for now, resume deportations of Venezuelan criminal illegal aliens under the Alien Enemies Act.  

“The Supreme Court has upheld the rule of law in our nation by allowing a president, whoever that may be, to be able to secure our borders, and protect our families and our country, itself,” President Donald Trump wrote on Truth Social following the court’s ruling, adding, “[a] great day for justice in America!”  

The 5-4 decision from the justices was narrow and did not address the constitutionality of using the Alien Enemies Act to deport members of the Venezuelan prison gang Tren de Aragua. Instead, the court said in its majority opinion, written by Justice Brett Kavanaugh, that “judicial review” was requested in the wrong court. The attorneys for the illegal alien should have filed their lawsuit against the deportations in Texas, where the illegal aliens were being held, instead of filing in Washington, D.C., the court found.  

“Importantly, as the Court stresses, the Court’s disagreement with the dissenters is not over whether the detainees receive judicial review of their transfers—all nine Members of the Court agree that judicial review is available. The only question is where that judicial review should occur,” Kavanaugh wrote.  

The Supreme Court ruled that illegal immigrants who are set to be deported under the Alien Enemies Act must be given notice of their removal and a chance to contest it.  

After designating Tren de Aragua as a Foreign Terrorist Organization, the White House announced in March that Trump would use the powers of the Alien Enemies Act of 1798 to remove members of the gang from America. Illegal aliens, who the Trump administration says are Tren de Aragua gang members, were then loaded onto airplanes and deported to a prison in El Salvador.  

Lawyers representing some of the illegal aliens filed a lawsuit in D.C. to challenge the deportations. Washington-based U.S. District Judge James Boasberg directed the administration to stop the flights and temporarily blocked the administration from using the Alien Enemies Act to deport illegal aliens. The Supreme Court’s ruling lifts Boasberg’s temporary restraining order.

Multiple legal experts have accused the left of “judge shopping” to seek favorable rulings in cases against the Trump administration.  

“Democrats and liberal groups have sprinted to their favorable venues and preferable judges. It’s known derisively as judge shopping,” Fox News legal analyst Gregg Jarrett said in March, calling the practice “highly unethical.”  

The Trump administration has carried out more than 100,000 deportations since Jan. 20. In fulfillment of Trump’s pledge to arrest and remove illegal aliens, Immigration and Customs Enforcement has also made 113,000 arrests.
