Democrats Plan State-Level ‘Resistance’ to Federal GOP Trifecta

Democrats started planning their opposition to President Donald Trump’s agenda just days after he was reelected last year, according to a new report, and are also preparing to combat his policies at the state level.

The Heritage Foundation’s Oversight Project reported this week that a coalition of 23 Democrat attorneys general signed a “secret agreement,” starting Nov. 8, 2024, pledging to oppose Trump’s anticipated immigration policies.

The concordat stipulates that the attorneys general “have agreed that they have a common interest in developing potential litigation to challenge executive action related to ending or curtailing birthright citizenship … ”

“Despite the mandate from the American People to end the border crisis and return immigration enforcement to the United States, politicians instead acted to frantically preserve their perceived political gains of the Biden Border Crisis,” The Oversight Project observed in reporting the agreement.

The group continued, “Their top priority was not gas, groceries, public safety, or any other matter of concerns of their citizen constituents, but instead a raw political calculus to ensure that the future children of the illegal aliens that entered during the Biden Border Crisis could turn into voters.”

The Oversight Project added, “Instead of trying to win back American voters, they seek to create new ones to replace them on the back of the worst border crisis in American history.”

In comments to The Washington Stand, Oversight Project attorney Neal Cornett said, “These blue-state attorneys general signed this agreement three days after President Trump’s resounding victory. The landslide election of President Trump is a clear mandate from the American people that they are tired of the Left’s open border scheme to reshape our country by mass illegal migration.” 

He added, “The rush to enter into a secret pact to undermine the will of the American people demonstrates yet again that the Left has no desire to work with the president to solve important problems facing the American people.”

FRC Action Director Matt Carpenter told The Washington Stand, “This development is best viewed as a rearguard action by state-level Democrats. It’s clear they view mass migration as critical to their long-term success, and Trump’s plans for securing the border and deportations is a direct threat to their goals.”

He continued, “Democratic policies of open borders, luxury hotel stays, and other publicly funded benefits for illegal immigrants was flatly rejected by voters in November. Now national Democrats face not just the prospect of a GOP trifecta, but also historic unpopularity and decline in voter registrations that imperils their chances in key states like Pennsylvania.”

Carpenter added, “They cannot risk the ire of the public for frustrating the mandate the voters gave the GOP in securing the border and deporting illegal immigrants, so they’ve relegated their resistance to a secret agreement at the state level, where they do control the governments.”

Parties to the “secret agreement” include the attorneys general of Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New Mexico, New York, Nevada, North Carolina, Oregon, Rhode Island, Vermont, Washington, Wisconsin, and the District of Columbia. San Francisco also joined the concordat in an addendum.

But not all efforts to stop Trump’s agenda are secret. On Tuesday, the Democratic Legislative Campaign Committee announced it would be targeting state legislatures in the 2026 midterms in order to stymie the president’s policies at the state level.

The “Target Map,” the Democratic Legislative Campaign Committee said, “pinpoints where Democrats must focus our attention and resources to strengthen our firewall in state legislatures and counterbalance the MAGA extremism of Donald Trump and the Republican Congress in Washington.”

The group continued, “While Donald Trump and MAGA extremists control Washington, state Democratic majorities are moving policy forward to improve lives and lower costs for families while protecting freedoms and expanding opportunities.”

The Democratic Legislative Campaign Committee’s target map denotes Alaska, Michigan, Minnesota, Pennsylvania, Virginia, and Wisconsin as battleground states, where Democrats have a majority (however slim) in one chamber of the state legislature that they intend to either expand or defend, or where they intend to expand a slight majority in both chambers.

Arizona, Georgia, New Hampshire, and North Carolina are classified as “power building” states, where the Democratic Legislative Campaign Committee sees its “best opportunities to gain seats in tough chambers and check MAGA extremism, including by defending the veto power of Democratic governors.” Maine was put on the Democratic Legislative Campaign Committee’s “watch list.”

Carpenter warned that “secret agreements” to thwart the president may endanger Democrats’ efforts to control state legislatures. “This could easily blow up in their faces and suddenly make the GOP competitive at the state level in places where they’ve historically been uncompetitive, states like New York, Illinois, New Jersey, and others,” he commented.
