EXCLUSIVE: Lawsuit Aims to Force Veterans Affairs to Disclose Information Related to Diverting Resources to Illegal Aliens Under Biden

The Veterans Affairs Department is facing a lawsuit after failing to disclose information related to the department’s alleged improper use of medical resources during the Biden administration to benefit illegal immigrants.
Following a Daily Signal report in August 2024, a policy organization in Washington asked the VA for more information related to its reputed use of employees to process cases of illegal aliens at the Immigration and Customs Enforcement’s Health Services Corps.
The Center to Advance Security in America, or CASA, received none of the information it requested from the VA.
“After CASA learned that the Biden administration was diverting resources from the VA to provide medical exams for illegal aliens, we filed a [Freedom of Information Act] request seeking records and communications,” James Fitzpatrick, director of CASA, told The Daily Signal.
“We received no response and now file suit to obtain the records and educate the American public on exactly how and why the Biden VA was diverting valuable resources intended for disabled veterans to provide wrap-around medical care and prescriptions to illegal aliens,” Fitzpatrick said.
Under the Biden administration, the “VA was focused on all sorts of completely unnecessary activities, such as helping Veterans attempt to change their sex and processing health care claims for illegal immigrants,” Pete Kasperowicz, press secretary for the VA, told The Daily Signal. “Under President Trump, the department has abandoned these radical liberal priorities and rededicated itself to providing the best possible care and benefits to the Veterans, families, caregivers and survivors we serve.”
The lawsuit, filed over the weekend in the U.S. District Court for the District of Columbia, aims to force the VA to release emails and various other communications regarding the Immigration and Customs Enforcement Health Services Corps, migrants, and the movement of “processors” from the VA to support immigration-related work.
During his campaign for president in 2023, Trump bashed then President Joe Biden, accusing him of putting the needs of “illegal aliens before homeless veterans.” With Trump’s return to the White House in January, the lawsuit aims to bring the unfulfilled Freedom of Information Act requests to the attention of the Trump administration.
In its original FOIA request to the VA in 2024, CASA cited a Daily Signal report that told the story of Army veteran Derick Carver.
Carver was severely injured in Afghanistan in 2010, losing his left leg, part of his right leg, and a number of fingers. After his catastrophic injuries, Carver told The Daily Signal he became acutely aware of the issues with VA hospitals. When he learned that the Biden administration was using VA resources to support illegal aliens, he began speaking out.
“The VA was caught moving processors from the VA to support [Immigration and Customs Enforcement Health Services Corps] processing detainee medicals,” Carver told The Daily Signal in August 2024.
An estimated 10 million or more illegal aliens entered the U.S. during the Biden administration, some of whom arrived with pressing medical needs, and Carver argued that the “care that the detainees are getting is better than a lot of what the veterans are getting—and without … the hoops to jump through.”
