DOJ Receives Tusli Gabbard’s Criminal Referral For Obama Russia Intel Controversy: Report

The Department of Justice (DOJ) has reportedly confirmed receipt of Director of National Intelligence Tulsi Gabbard’s criminal referral regarding bombshell allegations that former President Barack Obama and his team sought to gin up intelligence to create a narrative of Russian interference in the 2016 election.

Fox News broke the story on Monday that the DOJ had acknowledged receipt of the referral. A DOJ spokesperson declined to comment when The Daily Wire reached out to confirm the development.

The report did not have any details on the exact contents of the referral. However, Gabbard and President Donald Trump have said Obama, former FBI Director James Comey, former CIA Director John Brennan, and former Director of National Intelligence James Clapper were involved in the creation of the intelligence assessment released in early 2017.

Gabbard announced on this past weekend’s episode of “Sunday Morning Futures” that she was including uncovered documents linked to the Obama-era controversy to the Department of Justice and the FBI in a criminal referral.

“There’s no question in my mind that this intelligence community assessment that President Obama ordered be published which contained a manufactured intelligence document — it’s worse than even politicization of intelligence,” Gabbard told Fox News host Maria Bartiromo. “It was manufactured intelligence that sought to achieve President Obama and his team’s objective, which was undermining President Trump’s presidency and subverting the will of the American people.”

Ultimately, it will be up to federal prosecutors to open up a case. But some House Republicans are calling for arrests.

In a separate “Sunday Morning Futures” interview, Rep. Anna Paulina Luna (R-FL) outlined just what crime may have been committed in response to what Gabbard has dubbed a “treasonous conspiracy” by high-level officials to undermine Trump’s first term.

“There needs to be criminal prosecution and arrests,” Luna told Fox News host Maria Bartiromo. “Lying under oath, putting out a false intelligence report — that’s a violation of 18 U.S. Code 1001.”

Convictions could lead to several years in prison and financial penalties, Luna noted.

After calling for FISA reform, the congresswoman added, “There needs to be arrests. This is not partisan. This is simply illegal, what they did, and we’re simply upholding the law.”

Rep. Byron Donalds (R-FL), who is running to become Florida governor in the 2026 election, agreed with Luna during their joint appearance.

“There need to be arrests on this matter. People need to go to jail on this because this is about the republic,” Donalds said. “This is not about one president — it is about the presidency and the continuation of our country.”

Democrats have shrugged off the controversy.

“I actually hope that DOJ takes this to court. They won’t, because they know that the howls of laughter from that court will be heard in four time zones,” Rep. Jim Himes (D-CT), ranking member of the House Intelligence Committee, said on X. “Watch for DOJ action. Not gonna happen. And when it doesn’t, I hope all the MAGA very online people ask why.”

Senate Intelligence Committee Vice Chairman Mark Warner (D-VA) declared on Monday that Gabbard should not be the director of national intelligence.

Fibis I am just an average American. My teen years were in the late 70s and I participated in all that that decade offered. Started working young, too young. Then I joined the Army before I graduated High School. I spent 25 years in, mostly in Infantry units. Since then I've worked in information technology positions all at small family owned companies. At this rate I'll never be a tech millionaire. When I was young I rode horses as much as I could. I do believe I should have been a cowboy. I'm getting in the saddle again by taking riding lessons and see where it goes.
