Jane Doe’s attorney Thomas Giuffra submitted a letter to the court Wednesday urging it not to impose an order that would restrict all parties from discussing the case with the media. Attorneys for defendant Diego Sarabia had asked the judge on Monday to restrict lawyers and parties from commenting on the case, accusing Giuffra of running a media campaign that could taint the jury pool. Giuffra defended his own media appearances and accused defense attorneys of leaking documents to the press.
Giuffra named entertainment site TMZ in the letter, claiming that “2 Angry Men” podcast cohost Mark Geragos was using his relationship with the outlet to get information in front of the public because his daughter, Teny Geragos, is representing defendant Winston Lee.
Despite his accusations, Giuffra said he opposed restrictions on media appearances because he believed the defense would use surrogates to push a narrative and he would be left with no way to respond.
Andrew Miltenberg, who is representing defendant Gillio Lopes, fired back in a statement to TMZ on Thursday, saying in part, “Apparently, Mr. Giuffra believes media coverage is appropriate only when it serves his client’s interests.”
“The hypocrisy in Mr. Giuffra’s sudden outrage over defense counsel speaking to the media is astonishing. He spent weeks promoting his client’s allegations on television, in newspapers and across the internet, helping turn this case into a national media spectacle before the seven publicly identified defendants had a meaningful opportunity even to review the allegations, much less respond,” he wrote.
Miltenberg noted that Giuffra named the seven defendants in the lawsuit while protecting his client’s identity. While Miltenberg said he fully understood the importance of protecting her identity, he added that “[Giuffra] knew those young men would face intense public scrutiny, and he seemed perfectly comfortable with the resulting media frenzy when his side was driving the story.”
Doe alleges that seven fraternity members sexually assaulted her at the Chi Phi fraternity house in October 2024. The men have denied the allegations, saying either that the encounter was consensual or that they were not involved.
Miltenberg denied that he or any other defense attorney leaked documents and said Giuffra should substantiate the accusations.
“Jane Doe deserves privacy, respect and the opportunity to be heard. So does Gillio Lopes. Mr. Giuffra doesn’t get to use the media as a megaphone for his allegations and then demand that the defense put down its microphone. He cannot have it both ways,” Miltenberg concluded.
