Authorities arrested Franck Bazil, 31, as he exited a car wash in Lawrence, Indiana, on Oct. 4, according to the Indianapolis Star. He is charged with leaving the scene of an accident causing death or catastrophic injury and leaving the scene of an accident causing moderate or serious bodily injury.
Bazil crossed the border illegally on January 7, 2024, and was later released into the country, an Immigration and Customs Enforcement (ICE) spokesperson told The Daily Wire.
Officers responded to the Indianapolis crash around 1:30 p.m. on Oct. 4 after receiving a report of a child lying in the street, according to local news outlet WTHR. The officers found two brothers, ages 6 and 9, who had been hit by a black Ford SUV, which was no longer at the scene.
The 9-year-old, identified as Roland Jerome “RJ” McLain III, was taken to a nearby hospital where he died, WTHR reported. The crash happened hours before his ninth birthday party was set to begin.
Bazil allegedly told officers that he hit something while he was leaving an apartment complex and stopped briefly before fleeing out of fear when a bystander told him he had struck a child, according to the Indianapolis Star.
Bazil said he then drove around Indianapolis and called his relatives for advice, the outlet reported. His family members told him to turn himself in to the police.
The boys’ grandmother, LaQuisha Moore, said she believes “RJ tried to jump in the way” and that “witnesses said he tried to save his brother.”
Bazil received a Social Security card on February 29, 2024, and an Indiana driver’s license on November 8, 2025, according to the Marion County Sheriff’s Office.
The sheriff’s office said Brazil was mistakenly listed as an American citizen in his jail profile because he had a Social Security card and a driver’s license. The office said it later corrected the error.
ICE lodged a detainer with the Marion County Jail on the day of his arrest, asking local authorities to transfer him to federal immigration custody if they would otherwise release him.
“The safest way to arrest and remove criminal illegal aliens from our streets is by lodging arrest detainers. Seven of the top 10 safest cities in the United States cooperate with ICE,” the spokesperson said.
“Under President Trump and Secretary Mullin, our message is clear: criminal illegal aliens are not welcome in our country,” the spokesperson added.
