Sullivan issued the order Monday, after the jury list had initially been impounded for two weeks following the September 4 mistrial. The order keeps the identities of all jurors and alternates sealed indefinitely. The order can only be lifted if the trial judge issues another order.
Sullivan cited concerns about juror privacy and said that “at least one juror has requested that the order be extended indefinitely.” The judge also noted that jurors are free to identify themselves or speak publicly if they choose to.
“There have been a significant number of posts in various social media platforms that have raised issues regarding various reactions to the deliberations in this case,” the order reads. “There has been an individual who was arrested and charged with a violation […] by surreptitiously video recording the jurors leaving the court. There have been identifications of jurors and their personal information without their permission, through other sources. At least one juror has requested that the order be extended indefinitely.”
“Based on the circumstances of this trial and the fact that the case continues to receive daily, divisive attention in Massachusetts and beyond, the Court concludes that there is a real and present ‘risk of [personal] harm to the jurors [and] to the integrity of their service,’” the order continues. “The Court concludes that there is a risk of immediate and irreparable injury should the list be made available to the public at this time.”
“At least one juror requested that the order be extended indefinitely.”

The decision came amid intense public scrutiny of the jury, particularly after social media users claimed to have identified the lone holdout juror. The jury deadlocked after seven days of deliberations, with 11 jurors reportedly favoring a finding that Clancy was not criminally responsible for killing her three children by reason of insanity. The lone juror, fellow jurors complained, refused to agree with them.
At least five jurors — four females and one male — have publicly discussed the case and their deliberations. Three women, who chose to speak to the press just days after the mistrial, publicly complained that the holdout juror was “arrogant” and refused to agree with fellow jurors who were nurses when they gave him their medical expertise. Further, a juror named Paula Devlin revealed last week that the lone juror was a black male, the only minority on the otherwise all-white panel.
Devlin also shockingly admitted on “CBS Saturday Morning” that her decision to find Clancy not guilty by reason of insanity was motivated by her desire to “change something” and make things better for “other women in the future.”
“Even though we didn’t know what was going on outside of our little bubble that we were in, we knew that this was a turning point and this would be something that could change something, to make it better for other women in the future, for other families,” she said. “You know, justice for those children is this never happening again.”
Clancy has admitted to killing her three children — 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan — by strangling them one at a time with exercise bands in the family’s Duxbury, Massachusetts, home in January 2023. She sought to avoid criminal responsibility for the killings at trial by relying on what’s commonly referred to as the insanity defense.
The former labor and delivery nurse is currently being held at Tewksbury Hospital, a state-run psychiatric facility in Massachusetts, where she’s been in custody since 2023. It remains unclear whether the state will decide to retry Clancy for the killings.
