Judge Makes Rare Move As Lindsay Clancy Jury Remains Deadlocked

The jury of nine women and three men in Lindsay Clancy’s triple-murder trial remains deadlocked after nearly 28 hours of deliberations.

It is the second time in two days that the Massachusetts jury has told the judge it cannot reach a unanimous verdict.

“After much deliberation, we are still unable to come to a unanimous decision,” the jury said in a note to the judge.

In response, Judge Sullivan read the jury a Tuey-Rodriguez charge, an instruction given to a divided jury. The instruction encourages jurors to continue deliberating, reconsider their positions with an open mind, and make a renewed effort to reach a unanimous verdict.

“The verdict to which a juror agrees must be their own, the result of their own convictions, and not a mere acquiescence in the conclusions of their fellow jurors,” Sullivan said, reading the charge. “Yet, in order to bring 12 minds to a unanimous result, you must examine the questions submitted to you with candor and with proper regard and deference and respect to the opinions of each other.”

The judge added that the burden of proof remains with the prosecution but stressed that jurors considering acquittal should ask whether any doubt in their own minds is a reasonable one.

“With that, I now ask you to return to your deliberations with these thoughts in mind,” Sullivan said.

Clancy is on trial for the murder of her three children, 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan. She is facing the possibility of life in prison without parole.

Clancy has admitted to killing the young children by strangling them with exercise bands while inside the family’s home in Duxbury, Massachusetts. Her defense team is arguing that she was suffering psychosis and not criminally responsible.

The state has argued that Clancy methodically planned the killings and was criminally responsible for her actions, rejecting the defense’s claim that she was in a psychotic state that left her unable to understand the wrongfulness of what she was doing. The state said in closing arguments that Clancy gave up on trying to get better and decided to kill herself and also decided she was going to take her children with her.

Prosecutors said Clancy made many decisions leading up to the murders that show this was planned, like sending her husband Patrick out for two errands and looking up the time it would take for him to retrieve the takeout order. Clancy wasn’t suffering psychosis and was aware of her actions and knew right and wrong, the state argued.
