‘Legal Abomination’: Conservatives React To SCOTUS Birthright Citizenship Ruling

Conservatives, including Trump administration officials and GOP lawmakers, slammed the U.S. Supreme Court decision on Tuesday that effectively blocks the president from ending birthright citizenship, calling the ruling a “legal abomination” and an “atrocity.”

The landmark 5-4 ruling, which was authored by Chief Justice John Roberts, held that children born in the United States to parents unlawfully or temporarily present are “subject to the jurisdiction” of the United States and are citizens at birth under the 14th Amendment’s Citizenship Clause, The Daily Wire noted.

Stephen Miller, who serves as the White House Deputy Chief of Staff for Policy, said the ruling was “one of the most destructive and outrageous decisions in the long history of the Supreme Court.”

“American citizenship is not the birthright of the world. It belongs only and solely to Americans,” he added. “No provision of the Constitution can be read to require our national self-obliteration.” 

Following the ruling, President Donald Trump signaled that birthright citizenship could still be heavily restricted, posting an article from JustTheNews on Truth Social titled, “Trump’s efforts to reverse birthright citizenship may succeed with or without SCOTUS.” The piece notes that “a number of Congressional Republicans have legislation pending that could practically accomplish” ending birthright citizenship.

Texas Rep. Chip Roy (R) said the court “failed the American people, the Constitution, and the rule of law.” He added that the decision permits the continuation of a “dangerous cottage industry of traveling to our soil to manufacture United States citizenship.”

“Congress must act immediately and must not hide behind the fiction that it must amend the Constitution to fix this abuse of our laws,” Roy said. “To do otherwise would be an abject failure of the United States Congress.”

GOP Sen. Mike Lee (R) kept his reaction concise: “We’re going to need a constitutional amendment.”

Daily Wire co-founder Ben Shapiro called the ruling “a legal abomination.” “It’s just more evidence that Congress and multiple presidents, in abdicating their duty on immigration for decades, have screwed America irredeemably,” Shapiro said. The conservative explained in-depth the legal context and ramifications of the ruling on his show.

“The Supreme Court’s birthright citizenship decision is wrong, dangerous, and disastrous for American sovereignty and the American people,” Republican Sen. Eric Schmitt commented. “If we can’t fix it with ordinary legislation, then we must do what the Constitution commands in moments of national crisis: We must amend the Constitution and restore American citizenship. We must again put ‘We the People’ first.”

Douglass Mackey, who successfully fought the Biden DOJ after he was targeted over a meme, said the decision was “a bigger disaster than expected.”

“[Justices] Roberts and Barrett have completely sold out our birthright,” he wrote. “The Court has ruled that an Act of Congress CANNOT overturn Birthright Citizenship, only a Constitutional Amendment. Since it’s impossible to seal off the borders perfectly and indefinitely, this ruling dissolves the United States as we know it.”

“It’s the beginning of the end of the Republic unless and until we get a new Supreme Court to overturn this disastrous decision (like Roe v. Wade was eventually overturned),” Mackey added.

Daily Wire podcast host Matt Walsh commented, “Remember: the Somalian who was born to illegal immigrant parents 23 years ago has a ‘birthright’ to be in this country. But you are an invader who has no right to be here, even though your family has been in this country for 200 years. This is what the Left actually believes.”

TPUSA spokesman Andrew Kolvet called the ruling an “atrocity.”

“This is the worst possible decision on Birthright,” he wrote. “The Court just said that the 14th Amendment is absolute, even for illegals — which the drafters never intended. Congress can’t even fix it. This is Roe v Wade for Birthright. We’ll need to Dobbs the Court to undo this atrocity.”

I am just an average American. My teen years were in the late 70s and I participated in all that that decade offered. Started working young, too young. Then I joined the Army before I graduated High School. I spent 25 years in, mostly in Infantry units. Since then I've worked in information technology positions all at small family owned companies.
