Hinojosa has served in the Texas Legislature since 2017, and during her entire career, she has repeatedly voted against bills protecting law enforcement officers and defended defunding police department budgets. 

In 2020, at the height of the Black Lives Matter protests, the Austin City Council voted to approve cutting the police budget and diverting most of the funds to other non-law-enforcement sections of Austin’s police department, including victim services, communications, and forensics. 

Shortly after the council approved the budget cut, Hinojosa posted on X that the city cutting the budget wasn’t an issue. 

“Tell me how it makes sense to punish #ATX for diverting some police $ to other public safety priorities when ATX SPENDS MORE PER/CAPITA ON POLICE THAN ANY MAJOR CITY IN TX (more than Ft. Worth)? & WILL STILL BE SPENDING MORE THAN MOST,” Hinojosa wrote. 

In the Legislature, Hinojosa co-authored a bill that would have stripped law enforcement officers of protections from frivolous lawsuits. House Bill 88, known as the George Floyd Act, would have eliminated qualified immunity, allowing individuals to sue a peace officer if they believe they were deprived of their rights protected under the Texas Constitution. The bill was left pending in the Homeland Security and Public Safety Committee. 

During that same legislative session, Hinojosa voted against multiple bills that not only protected law enforcement but also prevented local counties and municipalities from defunding their police departments. 

Hinojosa was one of 12 House members who voted against House Bill 2366, legislation that increased the penalties for intentionally directing a laser pointer at a uniformed officer when the conduct causes bodily or serious bodily injury. It also created a new offense for intentionally using fireworks to interfere with a law enforcement officer performing official duties or to flee from a lawful arrest or detention. The bill passed and was signed by Gov. Greg Abbott. 

She also voted against House Bill 1900 and Senate Bill 23 during the same session. HB 1900 was legislation that protects county law enforcement from being defunded, while SB 23 was legislation that protects municipal police departments from being defunded. Both bills passed and were signed into law by Abbott. 

More recently, in a 2025 interview with CBS News, Hinojosa said that social issues, including defunding the police and child gender modifications, were “distractions.” 

“Those are issues that are distractions,” Hinojosa said. “I am here to focus my campaign on the issues that I hear about from Texans, which are not those issues.” 

Catherine Frazier, communications director for Texans for Greg Abbott, said that Hinojosa would be “dangerous” for Texas.

“Gina Hinojosa’s public safety record is embarrassing. No matter what she may say on the campaign trail, her record tells the real story: when given the chance to support Texas law enforcement, Gina has failed them time and again,” Frazier said. “Voters need to understand something very clearly—Gina’s Texas would be a more dangerous Texas.”  

Hinojosa did not respond to a request for comment by the time of publication. 

Election Day is Nov. 3.
