Judge Makes Call About Deadlocked Jury In Lindsay Clancy Trial

Judge William Sullivan on Wednesday sent home the jury serving on the Lindsay Clancy triple-murder case, setting up day six of deliberations on Thursday.

The jury, made up of nine women and three men, has so far told the judge on two occasions that they are deadlocked, once on Tuesday and once on Wednesday.

On Tuesday, jurors sent Judge Sullivan a note saying they were “unable to come to a unanimous decision.” The judge instructed them to continue deliberating. The next day, the jury sent back a note indicating the same deadlocked position. Sullivan then issued a final “Tuey-Rodriguez” or “dynamite” instruction, urging jurors to reconsider their positions and make every effort to reach a unanimous verdict before a mistrial could be declared.

“The verdict to which a juror agrees must be their own, the result of their own convictions, and not a mere acquiescence in the conclusions of their fellow jurors,” Sullivan said, reading the charge. “Yet, in order to bring 12 minds to a unanimous result, you must examine the questions submitted to you with candor and with proper regard and deference and respect to the opinions of each other.”

Clancy is on trial for the murder of her three children, 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan. She is facing the possibility of life in prison without parole if convicted on the most serious charge of first-degree murder.

Clancy has admitted to killing the young children by strangling them with exercise bands while inside the family’s home in Duxbury, Massachusetts. Her defense team is arguing that she was suffering postpartum psychosis and was not criminally responsible.

The state has argued that Clancy methodically planned the killings and was criminally responsible for her actions, rejecting the defense’s claim that she was in a psychotic state that left her unable to understand the wrongfulness of what she was doing. The state said in closing arguments that Clancy gave up on trying to get better, decided to kill herself, and decided she was going to take her children with her.

Prosecutors pointed to a series of decisions Clancy made leading up to the murders that show it was planned, such as sending her then-husband Patrick out for two errands and looking up the time it would take for him to retrieve the takeout order.

Clancy is currently in custody at Tewksbury State Hospital, a psychiatric hospital, where she is being transported to and from the courthouse.
