The children’s father got up after his wife alerted him to someone in their daughter’s room early in the morning on September 15, according to Fox 44. That’s when he allegedly found the naked illegal immigrant, Mexican national David Refugio Lopez, 28, in the closet near his son and daughter, who were also not wearing clothes.
When police arrived at the home, they found the victims’ father blocking Lopez in a closet, Fox 44 reported. Lopez had been allowed to get dressed before authorities arrived.
Police swiftly arrested Lopez, who came to the United States illegally in 2002 as a child, the Department of Homeland Security (DHS) told The Daily Wire. Lopez initially allegedly withheld his identity from authorities, leading to an additional charge in his case.
According to an arrest affidavit cited by Fox 44, police were told the daughter had let the man into the house without her parents’ approval, and she repeatedly said there had been no sexual contact.
Lopez is charged with two counts of indecency with a child, exposure, burglary of a habitation, and failure to identify, according to jail records. He is being held in the McLennan County Jail on a $60,000 bond.
Immigration and Customs Enforcement (ICE) lodged a detainer with the jail on the day of Lopez’s arrest, asking local authorities to transfer him to federal custody with the goal of deporting him when they release him.
“We are calling on Texas to honor our detainer,” a Homeland Security spokesperson said in a statement. “All of his claims will be heard by an immigration judge, and he will receive due process. This administration will not ignore the rule of law.”
“Under President Trump and Secretary Mullin, ICE is targeting the worst of the worst. Our message is clear: if you come into our country illegally and break our laws, we will find you, we will arrest you, and we will deport you,” the spokesperson added.
